These Terms of Use govern your access to and use of the Carib Radio mobile application and all related features, including radio streaming, live broadcasting, podcast playback, and the Caribbean newspaper directory. By using the Carib Radio app, you agree to these Terms of Use. If you do not agree, do not use the app.

1. WHO THESE TERMS APPLY TO

These Terms of Use apply to every person who downloads, installs, or accesses the Carib Radio mobile application ("App"), whether as a general listener, a registered user, or a client who hosts content on the platform.

References to "you" or "your" in these Terms of Use mean the individual using the App. References to "Carib Radio," "we," "us," or "our" mean [Carib Radio Legal Entity Name].

2. THE CARIB RADIO APP AND ITS FEATURES

The Carib Radio App provides four core features:

Radio Streaming. You can listen to live Caribbean radio stations that Carib Radio streams pursuant to written licensing agreements with the station owners. You are receiving a real-time audio stream only. No audio is downloaded to your device, and you have no right to record, capture, or save any broadcast.

Live Broadcasting. Registered clients can broadcast live audio or video content through the App using a licensed API integration. Listeners can tune in to client live streams in real time.

Podcast Playback. Clients who host their podcasts on Carib Radio make those podcasts available for on-demand listening through the App. Podcast content is owned by the client who created it. You may listen to episodes through the App; you may not download or redistribute them unless the platform expressly provides that functionality for a specific episode.

Caribbean Newspaper Directory. The App includes a curated list of links to Caribbean newspaper websites. Tapping a link opens that newspaper's own website in your browser. Carib Radio does not host, reproduce, or display newspaper articles. We are simply providing a directory of publicly available links.

3. LISTENING AND STREAMING: YOUR RIGHTS AND LIMITS

3.1 Your access to all audio content through the Carib Radio App is for personal, non-commercial listening only.

3.2 You may not:

(a) Record, capture, or store any radio stream, live stream, or podcast episode through any method, including screen recording, audio capture software, or any third-party tool;

(b) Rebroadcast, publicly perform, or publicly display any content streamed through the App without the express written permission of the content owner;

(c) Use any portion of any stream or podcast for commercial purposes without a separate written license from the content owner.

3.3 These restrictions exist because the content streamed through the App is licensed to Carib Radio by third-party rights holders. Your personal listening rights do not include any redistribution or reproduction rights.

4. PODCAST LISTENERS

4.1 Podcasts available through the App are produced and owned by the clients who host them on the Carib Radio platform.

4.2 By listening to a podcast through the App, you do not acquire any rights to the podcast content, its title, branding, or any other associated intellectual property.

4.3 Carib Radio does not endorse, verify, or take responsibility for the accuracy, completeness, or legality of any podcast content. Views expressed in podcasts are those of the podcast creators only.

5. PODCAST CLIENTS: UPLOADING AND HOSTING CONTENT

5.1 If you are a client who uploads podcast content to Carib Radio, you represent and warrant that:

(a) You own or have obtained all rights, licenses, and permissions necessary to upload, host, and distribute the content through the platform;

(b) Your content does not infringe upon the copyright, trademark, privacy, or other rights of any third party;

(c) Your content does not contain unlawful material, including but not limited to defamatory statements, material that incites violence or hatred, or content that violates any applicable law;

(d) Any music, sound effects, or third-party audio used in your podcast has been properly licensed for the use you are making of it.

5.2 By uploading content, you grant Carib Radio a non-exclusive, worldwide, royalty-free license to host, store, and distribute your content to users of the App for as long as your content remains on the platform.

5.3 You retain full ownership of your podcast content. Carib Radio does not claim any ownership rights over content you upload.

5.4 We reserve the right to remove any uploaded content that we determine, in our sole discretion, violates these Terms of Use or applicable law.

6. LIVE BROADCASTING CLIENTS

6.1 Clients who use the live broadcasting feature are solely responsible for all content they broadcast through the App.

6.2 You must not broadcast content that:

(a) Infringes the copyright or other intellectual property rights of any third party, including broadcasting music, video, or other media without the necessary licenses;

(b) Is defamatory, threatening, harassing, obscene, or otherwise unlawful;

(d) Constitutes advertising or commercial solicitation without prior agreement with Carib Radio.

6.3 Carib Radio provides the technical infrastructure for live broadcasting but does not monitor live broadcasts in real time. You are solely responsible for your compliance with all applicable laws during any live broadcast.

6.4 We reserve the right to terminate any live broadcast that we become aware violates these Terms of Use.

7. NEWSPAPER DIRECTORY

7.1 The newspaper directory in the App is a curated list of links to Caribbean newspaper websites. These links are provided for user convenience only.

7.2 Carib Radio does not reproduce, host, or scrape any content from the linked newspaper websites. All newspaper content remains on and is served by the newspaper's own website.

7.3 Carib Radio does not endorse any newspaper or the views expressed in any articles accessible through those links.

7.4 The availability and accuracy of links in the directory may change. Carib Radio is not responsible if a linked website is unavailable, moves its content, or changes its terms of access.

8. USER CONDUCT

When using the App, you agree that you will not:

(a) Use the App for any purpose that is unlawful or prohibited by these Terms of Use;

(b) Attempt to gain unauthorized access to any part of the App or its backend systems;

(d) Use any automated tool, scraper, or bot to access any part of the App;

(e) Engage in any conduct that could damage, disable, or impair the App or other users' ability to use it;

(f) Attempt to reproduce, record, or extract any audio or video content from the App by any technical means;

(g) Harass, threaten, or harm other users.

9. INTELLECTUAL PROPERTY IN THE APP

9.1 All software, design, branding, graphics, and original content created by Carib Radio within the App are protected by copyright, trademark, and other applicable intellectual property laws.

9.2 You are granted a limited, personal, non-transferable, revocable license to use the App on your personal device for lawful listening and viewing purposes only. This license does not permit you to copy, modify, distribute, sell, or create derivative works based on the App or any of its original content.

9.3 "Carib Radio" and all associated logos and marks are trademarks of [Carib Radio Legal Entity Name]. You may not use these marks without our express written permission.

10. THIRD-PARTY SERVICES AND TECHNOLOGY

10.1 The App uses third-party services and APIs to deliver certain features, including live streaming technology. By using those features, you may also be subject to the terms of service of those third-party providers.

10.2 Carib Radio is not responsible for the performance, availability, or terms of any third-party service integrated into the App.

11. AVAILABILITY AND CHANGES TO THE APP

11.1 We do not guarantee that the App or any feature will be available at any particular time or for any particular duration. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

11.2 We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice.

12. DISCLAIMER OF WARRANTIES

THE APP AND ALL CONTENT ACCESSIBLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CARIB RADIO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

13. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, CARIB RADIO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR SERVICE INTERRUPTION. CARIB RADIO'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED USD $100.00 OR THE AMOUNT YOU PAID TO CARIB RADIO IN THE PRECEDING TWELVE MONTHS, WHICHEVER IS GREATER.

14. CHANGES TO THESE TERMS OF USE

We may update these Terms of Use from time to time. When we do, we will update the "Last Updated" date at the top of this page. We may also notify you through the App or by email. Your continued use of the App after any changes constitutes your acceptance of the updated Terms of Use. If you do not agree to the updated terms, you must stop using the App.

15. GOVERNING LAW

These Terms of Use are governed by the laws of [Governing Jurisdiction] without regard to its conflict of law principles. Any disputes arising from these Terms of Use will be resolved in accordance with the dispute resolution procedures set out in the Carib Radio Terms and Conditions.
